Important: By accessing or using GitHunt, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Service.

1. Acceptance of Terms

By accessing or using GitHunt, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and GitHunt.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

GitHunt is a developer talent discovery platform that:

  • Searches and analyzes publicly available GitHub profiles and repositories
  • Generates reports ranking developers based on specified criteria (location, programming languages, tech stack, experience)
  • Provides detailed developer profiles including activity metrics, skills, and contact information where publicly available
  • Delivers secure report access links via email to view reports online

Data Source: All developer information is sourced from publicly available GitHub data via the GitHub API. We do not access private repositories or non-public information.

3. Eligibility

You must be at least 18 years old to use our Service. By using GitHunt, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into these Terms
  • You will comply with all applicable laws and regulations
  • All information you provide is accurate and complete

4. Acceptable Use

4.1 Permitted Use

You may use GitHunt for legitimate business purposes, including:

  • Recruiting and talent acquisition
  • Market research and competitive analysis
  • Building professional networks
  • Identifying collaboration opportunities

4.2 Prohibited Use

You agree NOT to use GitHunt for:

  • Spam or harassment: Sending unsolicited bulk emails or harassing developers
  • Data scraping: Using automated tools to scrape or harvest data from our Service
  • Illegal activities: Any purpose that violates applicable laws or regulations
  • Discrimination: Making hiring decisions based on protected characteristics
  • Resale: Reselling or redistributing reports without our written permission
  • Reverse engineering: Attempting to reverse engineer, decompile, or extract our algorithms
  • System interference: Interfering with or disrupting the Service or servers
  • Unauthorized access: Attempting to gain unauthorized access to any part of the Service
  • Privacy violations: Violating the privacy rights of individuals listed in reports

5. Payments and Pricing

5.1 Pricing

Pricing for reports is displayed on our website and may vary based on:

  • Location and market size
  • Number of developers in the report
  • Complexity of search criteria

5.2 Payment Processing

All payments are processed securely through Stripe, our third-party payment processor. By making a purchase, you agree to Stripe's Terms of Service.

5.3 Billing

  • All prices are in USD unless otherwise stated
  • Payment is required before report generation
  • You are responsible for all applicable taxes

5.4 No Refunds

All sales are final. We do not offer refunds once a report has been generated and delivered. However, if you experience technical issues preventing report delivery, please contact us within 48 hours.

6. Intellectual Property Rights

6.1 Our Rights

The Service, including all content, features, functionality, software, code, algorithms, designs, graphics, and trademarks, is owned by GitHunt and is protected by copyright, trademark, and other intellectual property laws.

6.2 Your Rights to Reports

Upon successful payment, you receive a limited, non-exclusive, non-transferable license to use the purchased report for your internal business purposes. This license does NOT permit:

  • Reselling or redistributing the report
  • Publishing the report publicly without developer consent
  • Using the report for purposes that violate privacy laws

6.3 GitHub Data

Developer information in reports is sourced from publicly available GitHub data. You acknowledge that:

  • GitHub's Terms of Service apply to the use of GitHub data
  • You will respect the privacy and intellectual property rights of developers
  • Information may become outdated as GitHub profiles change

7. Data and Privacy

Your use of GitHunt is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your personal information.

By using the Service, you consent to:

  • Our collection and use of your data as described in the Privacy Policy
  • Our use of cookies and analytics tools
  • Receiving transactional emails (report delivery, purchase confirmation)

8. Third-Party Services

Our Service integrates with third-party services, including:

  • GitHub API: For accessing public developer profiles
  • Stripe: For payment processing
  • Google Analytics: For website analytics
  • AWS: For cloud infrastructure and data storage
  • Resend: For email delivery

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services' practices or performance.

9. Disclaimers and Limitations of Liability

9.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Warranties that the Service will be uninterrupted, timely, secure, or error-free
  • Warranties regarding the accuracy, reliability, or completeness of results or data

9.2 Data Accuracy

While we strive for accuracy, we do not guarantee that:

  • Developer information is current or accurate
  • Our ranking algorithms perfectly match your hiring needs
  • All developers listed are available or interested in opportunities
  • Contact information (email, website, social media) is current or active

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GITHUNT SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Lost profits, revenue, data, or business opportunities
  • Hiring decisions made based on our reports
  • Errors or omissions in report data
  • Third-party service failures (GitHub API, Stripe, AWS, etc.)

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC REPORT GIVING RISE TO THE CLAIM.

9.4 GitHub API Limitations

Our Service depends on the GitHub API. We are not responsible for:

  • GitHub API rate limits or downtime
  • Changes to GitHub's API or terms of service
  • Inaccuracies in GitHub's public data

10. Indemnification

You agree to indemnify, defend, and hold harmless GitHunt, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party, including developers listed in reports
  • Your violation of applicable laws or regulations
  • Any hiring or business decisions made based on our reports

11. Report Delivery and Retention

11.1 Delivery

  • Reports are generated within 5-15 minutes of payment
  • A secure access link is sent to your email to view the report online
  • Reports are displayed in an interactive web format with detailed developer profiles
  • Ensure you provide a valid email address for report delivery

11.2 Retention

  • Report access links remain active for 30 days
  • After 30 days, reports are permanently deleted and links expire
  • You can access your report multiple times within the 30-day period
  • We recommend saving important information from your reports within this timeframe

11.3 Errors

If you do not receive your report or experience technical issues, contact us at support@githunt.ai within 48 hours.

12. Termination

12.1 By You

You may stop using the Service at any time. Purchased reports remain accessible for 30 days.

12.2 By Us

We reserve the right to suspend or terminate your access to the Service, without notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Abusive or harassing behavior
  • Excessive use that impacts service quality

12.3 Effect of Termination

Upon termination:

  • Your right to access the Service immediately ceases
  • You must cease using any reports obtained through the Service
  • No refunds will be provided for unused reports
  • Provisions that should survive termination will remain in effect

13. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will:

  • Post a notice on our website
  • Update the "Last Updated" date
  • Notify you via email if you have an account

Your continued use of the Service after changes constitutes acceptance of the new Terms. If you do not agree, stop using the Service immediately.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction where GitHunt operates, without regard to conflict of law principles.

14.2 Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through:

  1. Informal Negotiation: Contact us at legal@githunt.ai to resolve disputes informally
  2. Mediation: If informal resolution fails, disputes will be submitted to mediation
  3. Arbitration: If mediation fails, disputes will be resolved through binding arbitration

14.3 Class Action Waiver

You agree that disputes will be resolved on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GitHunt regarding the Service.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

15.5 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including GitHub API outages, AWS service disruptions, or natural disasters.
